You must submit your notice regarding the construction, major modification, or change in the hazard level of a heating oil consumption system to the competent authority well in advance. You are not required to submit a notice regarding the construction of such systems if

• an application for a suitability determination under the Water Resources Act has been filed for this system, or
• the system is subject to an approval procedure under other legal provisions, provided that compliance with the requirements of this regulation is also ensured as part of the approval procedure. In this case, significant modifications to the system that require approval are also exempt from the notification requirement.
