This ordinance serves to regulate livestock traffic to prevent the spread of animal diseases in Germany and beyond. The currently valid Livestock Traffic Ordinance was established on the basis of several EU directives to contain animal diseases during transportation and trade, especially when handling horses, cattle and pigs:
According to § 26, the keeping of cattle, pigs, sheep, goats, solipeds, chickens, ducks, geese, pheasants, guinea fowl, partridges, pigeons, turkeys, quails or ratites must be reported to the veterinary office. The notification must include the name and address of the keeper and the type, number and location of the animals kept. The veterinary authority does not check the legality of animal husbandry in accordance with building regulations.
The permissibility of keeping domestic livestock only becomes a matter of building law when stables are erected as structures. Whether the construction of a stable is permitted depends on many different individual factors (e.g. size of the structure, location on the property, any restrictions in the local development plan, if one exists, exact type of use, etc.). If there is no development plan, the project must fit in with the surroundings in order to be permitted. In this respect, permissibility depends on numerous different factors and can be assessed differently even for two nearby locations.
For this reason, there are no general building regulations; each inquiry must be considered and answered individually.
