The aim of the Lower Saxony Assembly Act is to present the law on assembly in a comprehensive manner and to make it comprehensible without in-depth knowledge of constitutional case law.
The protection of freedom of assembly is to be comprehensively guaranteed. At the same time, the Assembly Act is intended to effectively prevent unpeaceful and violent assemblies.
Compared to the old assembly law, the following advantages should be mentioned:
- The requirement for cooperation developed by case law is enshrined in law. The assembly authority is generally obliged to cooperate with the organizer. For the organizer, cooperation is an obligation.
- More legal certainty through explicit regulations on spontaneous and emergency assemblies.
- The dignity of the victims of National Socialist tyranny is to be preserved through regulations that apply to particularly symbolic places or days on which an assembly can be banned or at least restricted under simplified conditions.
- Official acts in accordance with the Lower Saxony Assembly Act are free of charge.
