You must submit your notification regarding the construction, major modification, or change in the hazard level of a facility subject to inspection to the competent authority in a timely manner in advance.

You are not required to file a notice for the construction of these facilities if

• an application for a suitability determination under the Water Resources Act has been filed for facilities used to store, fill, or handle water-polluting substances, or
• the facilities are subject to an approval procedure under other legal provisions, provided that compliance with the requirements of this regulation is also ensured in the approval procedure. In this case, substantial modifications to the facility that require approval are also not subject to notification.
