Cross-border road haulage - Applying for a driver attestation

Operators of commercial road haulage services with Community licenses who use drivers who do not belong to a member state of the European Union (EU) or a state party to the Agreement on the European Economic Area or Switzerland require a driver attestation for the persons concerned. You as the employer must apply for the certificate for your driving personnel.

The driver attestation authorizes the driving personnel to drive the vehicle on behalf of your company within the EU.

It is issued for a period of up to 5 years. However, it can also be issued for a shorter period if the residence permit, Community license or passport expires earlier. This means that the driver's certificate becomes invalid as soon as the requirements are no longer met. If the employment relationship is terminated, the driver attestation must be returned to the licensing authority.

Drivers must carry the original driver attestation with them on every journey. A certified copy of the driver's certificate must be kept on the premises of your company.

The regulation serves as proof that no illegal or abusive employment of workers from third countries is taking place.

You do not need to apply for a driver attestation for persons with a permanent residence permit. In this case, an application is at your own discretion.
