Immission control: Review - due to impairment

Description

Neighbors of an installation or property must tolerate immissions to a certain extent if they are not or only insignificantly affected by them.

An insignificant impairment exists if the official limit or guideline values of the First General Administrative Regulation to the Federal Immission Control Act (TA-Luft) or the Sixth General Administrative Regulation to the Federal Immission Control Act (TA-Lärm) are not exceeded.

If it is assumed that the customary local level is exceeded (e.g. factory noise at industrial sites), a check can be arranged with the responsible authority.
