With basic income support in old age and in the event of reduced earning capacity, the legislator created a form of benefit that is intended to cover the necessary living expenses of people who are no longer available to the labor market due to old age or full reduction in earning capacity and whose income and assets are insufficient to cover their necessary living expenses.

In principle, persons who are habitually resident in Germany and who have reached the required age limit or persons who have reached the age of 18 and are permanently fully incapacitated for work and are unable to cover their necessary living expenses from their own resources are eligible.

Basic income support benefits are made up of the relevant standard rate and reasonable accommodation costs. In individual cases, additional needs may also be granted, for example if you have a severely disabled person's pass with the "G" mark. Contributions to voluntary health and long-term care insurance can also be paid, depending on the individual case. Receipt of a pension due to old age or full reduction in earning capacity is not a prerequisite for the means-tested social benefit.

Maintenance claims of those entitled to basic income support against their children and parents are not taken into account if their total annual income is less than 100,000 euros.

Definition of "need for long-term care" according to § 14 Social Code XI. Part -Care Insurance- (SGB XI)

Persons in need of long-term care within the meaning of this law are those who have health-related impairments to their independence or abilities and therefore require assistance from others. They must be persons who are unable to independently compensate for or cope with physical, cognitive or mental impairments or health-related burdens or demands. The need for care must be permanent, probably for at least six months.

If you have long-term care insurance, your long-term care insurance fund is primarily responsible for granting the benefit. The long-term care insurance fund determines the need for long-term care through its medical service and classifies you in a care degree.

Home care (outpatient care)

If care is provided at home by family members, friends or neighbors (caregivers), the care insurance fund will pay a care allowance.

If an outpatient care service is commissioned to provide care, your care insurance will contribute to the costs (care benefit in kind).

In the case of home care, it is also possible to choose a combination of cash and care benefits in kind. In addition, in the case of home care, you are entitled to care advice and a care course for family caregivers. Furthermore, the care insurance fund reimburses up to €42 per month for care aids.

If the benefits provided by the care insurance fund are not sufficient for outpatient care, you have the option of applying for care assistance in accordance with Social Security Code XII. Part -social assistance- at the specialist service for social affairs and senior citizens to close the cost gap. However, this depends on the income and assets of you and your spouse/partner.

Short-term care involves admission to a full inpatient care facility for a maximum of 8 weeks per calendar year. Short-term care is provided

• for a transitional period following inpatient treatment of the person in need of care
• to bridge the gap until a suitable care place is available or
• in crisis situations in which home or partial inpatient care is temporarily not possible or not sufficient.

The prerequisite is classification in a care degree. If a care level is not yet available, the hospital can arrange for classification as part of discharge management. Short-term care is also approved in the case of limited everyday competence even for care grade 1, but in these cases only a relief amount of up to €125 per month is granted

An extension of the entitlement from 4 to up to 8 weeks is only possible by offsetting against unused respite care. The benefit from the care insurance fund is up to €1,854 per year and can be increased from 4 weeks to up to 8 weeks and from €1,854 to up to €3,539 by extending the benefit as described.

Tip:

Patients who require temporary nursing care following a serious illness, e.g. after hospitalization or outpatient surgery, can take advantage of short-term care in a suitable facility. This entitlement applies to people who are not yet in need of care within the meaning of social long-term care insurance and therefore cannot receive care services. The statutory health insurance fund is responsible for this.

Preventive care

Preventive care has also been made more flexible. It is granted due to vacation, illness or other reasons why the caregiver is unavailable. Preventive care can be claimed for up to 6 weeks, taking into account the entitlement to short-term care. Up to €2,528 per year is available for respite care (taking into account up to €843 from short-term care). This makes it easier for family carers to choose the support that best helps them in their specific situation.

If home care is not possible or is no longer sufficient, full inpatient care in a retirement and nursing home may be considered.

An application for full inpatient care must be submitted to the care insurance fund as a matter of priority. If no care level (PG) has yet been determined, the Medical Service of the Health Insurance Funds (MDK) will check the need for care. If a care degree is determined, a place in a nursing home can be booked. The care insurance fund contributes to the care costs as follows:

¹ For care level 1, only an allowance of €131 is paid for inpatient care.

In addition to the nursing care component, care home costs also include the cost of meals, housing costs and investment costs.

If you are unable to cover the nursing home costs incurred from the benefits provided by the care insurance fund and your own income and assets, you have the option of applying for care assistance in accordance with Social Security Code XII. Part -social assistance- at the specialist service for social affairs and senior citizens to close the cost gap. This benefit includes a monthly allowance, the so-called cash amount, for personal use (e.g. for attending events, toiletries, hairdresser, etc.). However, this depends on the income and assets of you and your spouse/partner.

Social assistance must be applied for from the Social Welfare and Senior Citizens Service before admission to the home, as it only comes into effect on the day of notification.
